Contract Expertise

The buyer’s agent submitted to Jennifer a massive list of repair requests, including a new roof and brand new appliances. Jennifer saw the agent’s email was sent at 12:43am and realized this was 43 minutes AFTER the buyer’s inspection window had officially timed out at midnight. By pointing out page 6, line 298 as well as page 9, line 428 of the Purchase and Sale Agreement, the buyer was deemed to have accepted the house in ‘as-is’ condition.

Due Dilligence

Our sellers received a great offer in which the buyers stated they were using a conventional loan and putting 20% down but their financing letter was not attached. Jennifer inquired who the buyer’s lender was and called repeatedly until she obtained a copy of their pre-approval. This showed they were actually using an FHA loan, couldn’t waive the appraisal and were only putting 3% down. Whether accidental or deliberate, the buyer’s true financing was not how they represented themselves. Our sellers decided to select a different offer. 

RESULT: Jennifer’s persistence and pro-activity revealed the buyers were not strong financially BEFORE our sellers went under contract with them.

Increased Seller's List Price

Prior to listing on the market, a seller told Jennifer their home’s square footage was 3100 sq ft. Jennifer encouraged the home owner to allow professional measurement ( cost included in her services ) which revealed a further 325 square feet! This enabled Jennifer to list the home for a whopping $ 75,000 above their original list price.

RESULT: Due to Jennifer’s professional measurements, the sellers received $75,000 more than originally anticipated.

Anticipating and Preventing Problems

In a multiple offer situation, our sellers liked one particular offer which was $100k above list price. However, the buyers had only offered $25,000 appraisal deficiency gap. That means if the appraisal came back low, the buyers would only add $25,000 to the appraisal value. Jennifer encouraged the sellers to counter this and succeeded in getting the buyer’s appraisal gap increased to $50,000. The appraisal did come back $35,000 low but the negotiated increase covered it.

Contract Knowledge

The buyer’s agent contacted Jennifer to advise the house failed appraisal. According to the contract the buyer had 3 days to inform the sellers of this and negotiate a solution or continue with the contract. Jennifer suspected the buyers had known this for some time and reached out to the buyer’s lender directly to confirm when they were advised of this low appraisal. With email and time stamped evidence, Jennifer was able to point out the buyer’ agent hadn’t notified the sellers within the contractual timeframe so it was no longer the sellers concern. 

RESULT: Jennifer’s caught another buyer agent mistake. By not notifying the sellers within the contractual timeframe, the buyers had to absorb the low appraisal themselves. This saved the sellers up to $14,000.
